Does Moral Legalization Confront Predicament?——Discussed with Professor DAI Mao-tang
摘要
Abstract
DAI's demonstration about the predicament of moral legalization in his article, which is from context execute the law and justice, has contextual mistake. He can not penetrate the inner correlation between morality and law and reveal the cause of the shortcoming about moral legalization in ancient China, which is the inappropriate moral legalization rather than moral legalization itself. The necessity of moral legalization stem form the incompletable of morality which need complement of law.The suprem value between morality and law is correspond with each other while content shared with each other.关键词
