Abstract
The western countries take the division model of conviction and measurement of penalty, while our country follows the joint model. In order to make the measurement of penalty reasonable and correct, it is necessary to learn from the western countries.However, the establishment of independent procedure of it can bring out many problems, one of those important problems is the applicablity of the evidence. In general, in the process of evidence applicablity, all the evidence influeneing the measurement of penalty should be the objects to be testified, the testifying standard with high probability should be established, and the method of free testification should he followed.关键词
