Abstract

From its contents, people having the mining right are entitled to possession, use, income, disposition of all rights; From its acquisition and exercise, it is not from the administrative power, but state ownership of mineral resources and free to exercise. So the mineral exploration right is a private right and civil property right. The mineral exploration right is fully equipped with all the features of the general real rights, including the direct control of a material,exclusive, priority and so on. And it also follows the basic principles of property law. The mineral exploration right should be a real right and based on state ownership of mineral resources on the property, that is an usufructuary right.关键词
