Legal Protection of Industry Associations Participating Effectively in Standard-setting ——Talking from the "Electric Motor Standards War"

Abstract
Electric motor standards war shows that the fight of industry associations to participate standards developing activities has been placed emphasis more than ever before by the China' s legislation, but the legal mechanism has not been established to provide protection for industry associations to participate effectively in standard-setting. As the standard-setting over-reliance on government departments or industry associations will affect the regulatory system to achieve a public purpose, it is necessary to provide for such procedures as notice and comment, reason-giving, and impact assessment to protect industry association participating in the formulation of national standards fully and effectively in order to achieve fair and reasonable in standards developing.关键词
