Abstract
OBJECTIVE: To establish relief-compensation linkage mechanism of drug misadventures in China to protect the rights of victims. METHODS: The types of drug misadventures were introduced, and the necessity and difficulty of relief and compensation to drug misadventures were analyzed. RESULTS & CONCLUSIONS: At the present, the responsibility to drug misadventures is clear under current law and regularity but it is difficult to achieve compensation. ADR relief system hasn't been established in China and enough evidence can't be obtained to certify drug misadventures. The relief-compensation organization of drug misadventures should be established in Department of Health, which is in charge of receiving filing, identification, fund management and payment, litigation and organization coordination of drug misadventures to build relief-compensation linkage mechanism of drug misadventures in China.关键词
