Abstract
OBJECTIVE: To make the majority of medical personnel understand fault, causation standard of Tort Law of the People' s Republic of China in judicial practice by the case discussed, a typical abuse of antibiotics. METHODS: Social harm caused by abuse of antibiotics and standards of some legal issues were described by empirical methods. RESULTS&CONCLU-SION: Medical personnel should strictly control the indications, dosage and usage of antibiotics used. And abuse of antibiotics should involve medical staff in no-trade punishment mechanism.关键词
