摘要
Abstract
In the development of Western legal thought history,the natural law,utilitarianism law,analysis of legal positivism and social law and other schools were created.The theories contain instructive ideas for the rights of land contractual management and transfer system,such as Locke＇s liberal theory,Austin＇s positive law theory and Holmes＇ realism theory;and therefore,it is necessary to discuss theoretical basis of the land contract and the transfer of management rights from the perspective of jurisprudence.关键词
