The Validity and Legitimacy of the Assistance of Deputies to the People＇s Congress in Litigation Mediation on the Point of Constitutionalism
摘要
Abstract
In recent years, the judicial practice of litigation mediation with the assistance of deputies to the People＇s Congress carried out in Quanzhou Intermediate People＇s Court, produces much influence in Fujian province as well as the whole country. In this article the author discusses the subject with a great theoretic value and practical significance, analyzes the validity and legitimacy of this sort of litigation mediation on the point of constitutionalism, and tries to discover its constitutionalism value of the system from multiple angles and levels, responding to some scholar＇ s suspicions. This approved the pioneering and feasibility of the system. But we must be aware of its side effects when spreading it. On judicial concept, we should adhere to procedure justice and give the mediation system a correct and reasonable judge.关键词
