摘要
Abstract
The Law on the Application of Laws to Foreign-related Civil Relationships of the People＇s Republic of China,effective as of 1 April,2011,is the first relatively complete and systematic law in the New China which formulates the rules of private international law.This law has extensively taken in the advanced theories of contemporary private international laws,successfully drawn upon the legislative experience of countries the world over,and comprehensively summarized the practical legislative and judicial experience of China over the past three decades.Based on relevant research and survey on the Law on the Application of Laws to Foreign-related Civil Relationships of the People＇s Republic of China,the paper theoretically elaborates on and practically summarizes the application of laws to creditor＇s rights in foreign-related civil affairs,especially to such typical cases involving foreign-related contracts and torts.Comments and suggestions are also made pertaining to the ensuing revision,amendment,modification,and supplementation of this law.关键词
