摘要
Abstract
Learning from reasonable domestic viewpoints and using legislative experience from abroad for reference,further revision to the theory of ＂the reason strength＂ is carried on.It considers that： ＂part of the act take full responsibility＂,which is claimed by common theory,would not be able to achieve the sentencing principles of distinction,but also contrary to the law of fair value;to the definition of the discontinuation of a joint crime,the principle of integrating the subject and the object should be obeyed,and different types of crime and the roles which perpetrators play in the joint offense process should be treated differently;in some exceptional cases,the identification of the subjective aspects should not be too strict.关键词
