Discussion on Relationship between Standards and Patents

Abstract
In this paper,the relationship between standards and patents has been elaborated from several perspectives, including the commonalities and differences between standard and patent technology in terms of contents, the differences between standard and patent right in nature and legal characteristics, and the ho-moplasy in ultimate goals of standardization system and patent system, which provide the references for explaining the validity of combination of standard and patent and the conflict between standard implementation and patent right.关键词
