留置权限制探析
Researches on the Limitation to the Lien
摘要
Abstract
Property Law has established and defined many important legal systems of real right. It enlarges the range of the lien, meanwhile, the system of commercial lien has been established and the principle that the lien priors to mortgage right and the right of pledge has been defined. These changes are of great significance in guarantee- ing the realization of the creditor＇s rights. However, there exist a lot of disputes on the limitation to the lien in academia. Combining the related legal provisions in foreign countries with China＇s judicial practice, the article explores and analyses the lien＇s limitation from different aspects, such as the restrictions on its establishment and on the subject matter.关键词
