Review on the Standardization Agreement Terms of the EU New Guidelines to Horizontal Co-operation Agreements
摘要
Abstract
Compared to the 2001 Guidelines, New Guidelines included in its coverage of Standard Clause which making the antitrust regulation of Standardization Agreement more comprehensive. The assessment under article 101(1) of the Treaty on the Functioning of the European Union includes three points: main competition concerns, restrictions of competition by object and, restrictive effects on competilion. The assessment under article 101(3) of the Treaty on the Functioning of the European Union includes four points: efficiency gains, indispensability, pass-on to consumers and, no elimination of competition. New Guidelines detailed the anti-monopoly rules and, enhanced operability. Also, New Guidelines adhered to the rule of reason and, intervened standardization activities carefully.关键词
