On the Allocation of Proof Burden in the Actions of Chinese Environment Torts
摘要
Abstract
The allocation of proof burden is the important link of environment civil tort action.Burden of proof allocation system will affect the realization of the aim of legislation and the protection of the environmental civil right in the action of environmental tort.Along with the increase of the number of environmental tort actions,the allocation system of proof burden in the action of environmental torts is imperfective in the relevant system in China.The authors believe that China should set up perfect environment tort shifting of the burden of proof as soon as possible,expand the scope of application of this principle,regulate the environment infringement proceedings in the judge＇s judicial discretion in relevant system.关键词
