Abstract
Since the competition of liability for breach of contract and tort liability was proposed, academic circles has put forward some kinds of theories, especially law competition, the issues competition, the standard to claim competition. It is worth pondering if these theories really solve the competition problems. Concurrence theories of responsibility of breach of contract and tort liability in the treatment of the competition questions are analyzed and the defects of the competition doctrine are pointed out, and finally the legal conceptions of concurrence are DUt forward.关键词
