中澳合同法诚实信用原则比较研究

摘要
Abstract
Honesty-credit principle is the basic in contract law, so it is of theoretical and practical importance to under- stand and apply honesty--credit principle in practice. This article introduced the different views of Australian scholars and judges and basic connotation of honesty--credit principle in Australia. Then it summarized the contents and requirements of honesty--credit principle in China and compared them with Australian＇s. It proposed that subjective honesty, objective honesty and reasonable considering other parties interest should be included in the honesty--credit principle in China.关键词
