两岸植物新品种权法律制度比较研究
Comparative Study of the Cross-Strait New Plant Varieties Legal Systems
摘要
Abstract
＂Cross-Strait cooperation in IPR protection agreement＂ was signed with ＂Cross-Strait Economic Cooperation Frame- work Agreement＂ on June 29, 2010.According the cross-strait cooperation mechanism for the protection of new varieties of plants in the agreement, the legal basis has been built on which agricultural operators from one party can apply new varieties of plants in the other party.However,there are some difference between the two legal systems of new varieties of plants.Threrefore,it is urgent to study the two legal systems by comparison. The study will instruct the cross-strait agricultural operators including breeders to avoid legal risk and safeguard legal rights and interests,and to deepen cross-strait cooperation.关键词
