Abstract
It is controversial whether the fiction of house transactions is valid or not. The main reason is we don't define it as misrepresentation, misrepresentation shall be invalid between the parties, but it is not against the bona tides third party. We have not regulated the misrepresentation, when we draft the civil code, we should regulate the misrepresentation and we should regulate the rights and obligation between the parties, the bone fide third party's rights, the act of concealment as well as the rule that the parties who make misrepresentation cannot benefit in particular.关键词
