The Connotation, Appraise and Reference of Strict Liability
摘要
Abstract
Strict liability is a special concept in Criminal Law in Anglo-American Law System. It can be divided into absolute strict liability and comparative strict liability. Although absolute strict liability has certain rationality, yet it doesnt accord with Culpability Theory and criminal law principle of unity of subject and object with defect in justice, it should be denied. Comparative strict liability overcomes the defect of absolute strict liability and embodies considerable rationality, so it should be affirmed. When we bring in comparative strict liability, we should make detailed design in two aspects of program and entity.关键词
