从属性上讲,我国防灾减灾法不只是行政管理法,而应是社会安全与可持续发展保障法；我国防灾减灾法不纯粹是公法,而应是公法与私法兼备的综合法.从地位来看,我国防灾减灾法是一个新兴的独立的法律部门.在中国特色社会主义法律体系中,我国《防灾减灾法》是一部重要的新兴的基本法与综合法.
Disaster Prevention and Mitigation Act of China are not only the administrative regulations, but the social security act in properties. Disaster Prevention and Mitigation Act of China is not a public law purely, but an integrated law which combines with the characteristics of a public law and a private law. And talking of the status, Disaster Prevention and Mitigation Act of China is not only an independent law, but also an emerging legal branch, and in the legal system of Chinese socialism, it should be a law which is important, independent and emerging.
