论我国宪法对文化基本权利的保障
Discussion of the Chinese Constitution guaranteeing the Basic Cultural Rights
摘要
Abstract
The scope of protection of cultural rights in our Constitution does not include the education right and religion freedom. With respect to the guarantee of cultural basic rights, the current constitution not only partly establishes the national cultural policy in "general principles" , but also obviously regulates the cultural rights of the freedom and social rights nature in chapter I. Besides, it also establishes the organic system of the country achieving the cultural tasks in chapter III. In current Constitutional regime, cultural basic rights that has the virtue of freedom nature, still exist some obstacles for judicial safeguard, though there exists the normative force of subjective rights. Cultural right with the nature of the social rights in chapter II fundamental rights and duties of citizens only has the constitution commissioned effect.关键词
