On the Influencing Factors of the Amount of Patent Infringement Damages:An Empirical Study Based on the Court Cases in 24 Regions
摘要
Abstract
Based on the sample of the patent infringement cases judged by 43 courts in 24 provinces, municipalities, and autonomous re-gions, an empirical study is conducted to explore the impact factors of the amount of patent infringement damages in China. The results show that:the type of patent, the numbers of ways of infringement, the amount of claimed damages, and eastern region variables have a positive significant effect on the amount of damages judged, while the time duration of infringement, the number of infringer and the year variables have not. Finally, some recommendations on the patentee's proof and the improvement of relevant systems are presented.关键词
