Feasibility and Supporting Measures of Abolishing the System of Reeducation through Labor
摘要
Abstract
For more than 50 years, the system of reeducation through labor has been playing a positive role in maintaining na-tional safety and stability.But this system also has drawbacks, such as contradiction with legislative spirit, unbalanced penalty proportion and imperfect supervision mechanism .With the decease of the number of personnel being reeducated through labor , it is obviously feasible to abolish this system for the following reasons.Firstly, laws and regulations against crimes have been perfec-ted; secondly, the ability of judicial authority to control the social security has great improved .We must control the approval strict-ly, gradually release the personnel receiving reeducation through labor and announced the system abolishment at appropriate time . Meanwhile, relevant laws and regulations should be issued to fill the gap of law.关键词
