Increasing the Contents of the Excavation Area should be Stipulated in the New Modiifcation of Mineral Resources Law
摘要
Abstract
In order to make mining right holders explore and exploit mineral resources more economically and reasonably, the concept of increasing excavation area should be introduced. The legislation in this respect has been made in Taiwan of China, Japan and Korea with the characteristics of properly restraining the mining right of the holders, respecting for autonomy of the intention of the two sides, and supported by intervene of public power. This paper analyses the existing problems in the present laws in relevant respect such as no clear statutory circumstances of the mining area adjustment;and no regulations for increasing excavation area to adjacent mining area. On account of this, this paper suggests that statutory causes for mining right holders to increase excavation area should be explicitly stipulated. The issue of excavating to the adjacent mining area should be stipulated systematically. And property law protecting the mining right of holders must be deifned clearly.关键词
