论执行异议之诉中隐名股东资格的确认
On Confirmation of Shareholder Qualification of Third Party Execution Objection Litigation
摘要
Abstract
The 227th text of China′s “Civil Procedure Law” stipulates third party of the litigation of executive objection,the purpose of the legislation required the executive court to found third party to the implementation of the subject which is entitled to substantive rights,whether it can request removal of compulsory execution.Compa-ny law have private law,trade law and group characteristic,but the essence is still belongs to private law,capital contribution belongs to the essential characteristic,the articles of association of the company,business registration, register of the shareholders and other shareholders belong to formal characteristic.When all types of feature of ap-pearing in the same litigation,real quality characteristic and formal characteristic conflicts with each other,we should take the “measure”in the case of the interest of the method to realize the substantive law and the procedural law of justice.The special rules to confirm the qualification of shareholder in dissent action of execution should fol-low the essential characteristic of priority,then we decide whether to continually enforce executive subject.关键词
