《不动产登记暂行条例》的若干评析与建议
Several Comments and Suggestions on The Real Estate Registration Interim Regulations
摘要
Abstract
In accordance with the provisions of the property law and requirements,The Real Estate Registration In-terim Regulations carries out unified registration of immovable property,changes current real estate status of “bull registration”.It is beneficial to determine ownership of real estate and maintain security of transaction.Mineral ex-ploration right ,mining right and the water intake right in part of general provisions is omited.The real estate reg-istration agencies isn′t determined nationwide.So there is no true sense of the unified registration of immovable property.Interim Regulations for the first time stipulate the real property register settings,custody,access to con-tent,but still lacks the registration book of legal validity,did not completely implement the principle of publicity and trust.The Provisional Regulations isn′t integrated procedural provisions of property law.But the provisions for the registration application review obligations is clear,specific.Based on clear review obligations,citing the “prop-erty law”provisions of the liability of the registration agency to determine the registration liability is reasonable.关键词
