基于健康保护的环境规制--以«环境保护法»修订案第三十九条为中心
Environmental Regulations for Health Protection Objective:On Article 39 of Amendment of Environmental Protection Law as the Core

Abstract
China′ s environmental regulation authority is allocated according to the current administrative division, with meeting discharge standards as the goal. It is based on classical reductionism and determinism, which can barely live up to the health protection objective. The regulations put the health priority in ground of fragmentation. Article 39 of Amendment of Environmental Protection Law responds to such a dilemma and initially manifests health priority, steering risks and integrating resources, marking the shift of priority in China′s envi-ronmental regulations from pollution prevention to health protection. Since it serves only as the guideline of Chi-na′s environmental regulations with health priority, it is necessary to pass a special legislation. Before the special legislation being established, we should promote the job with a systematic interpretation to the Amendment of En-vironmental Protection Law.关键词
