基于专利信息的我国发明专利无效行为实证研究
An Empirical Study on Invention Patent Invalidation Behavior in China Based on Patent Information
摘要
Abstract
During 1985-2013, the Patent Reexamination Board of SIPO has made a total of 2 463 items of invention patents invalid deci-sions in which 2 035 items of invention patents are involved. Based on both patent application information and patent legal status informa-tion, the paper constructs patent claims number, patent inventor number, IPC number, patent family size and patent stability indicator, and makes an empirical study on invention patent invalidation behavior in China from time, patent holder and technology dimensions. The empirical results about characteristics of patent invalidation behavior, patent stability and their influencing factors enrich the researches on patent invalidation system and strategic patent behavior in China.关键词
