《开罗宣言》对台湾及钓鱼岛归还中国的认定
Cairo Declaration’s Affirmation of the Restoration of Taiwan along with Diaoyu Islands to China
摘要
Abstract
Cairo Declaration,as an authoritative international treaty which was promulgated by the leaders of China,the United States and the United Kingdom and confirmed by the leader of the Soviet Union in WWII,affirmed that all Chinese territories including Taiwan that were stolen by Japan must be restored to China.The Potsdam Proclamation that was signed off by the leaders of China,the United States and the U-nited Kingdom,joined later by the Soviet Union declared to carry out the Cairo Declaration solemnly.The rights and obligations of the contracting countries were stipulated explicitly both in the Declaration and the Proclamation,as well as the inviolable mandatory clauses for the treaty object country Japan.Japan’s sur-render was accepted by the Allies only because Japan had met with the prerequisite condition by accepting all mandatory clauses of the Potsdam Proclamation.The constitution of Cairo Declaration as a fully integrat-ed international treaty was affirmed by a chain of evidences,legal principles and logical historical facts.Di-aoyu Islands are affiliated islands of Taiwan,their territorial sovereignty belongs to China,so China’s sov-ereignty over the Diaoyu Islands is unquestionably beyond doubt.关键词
