Basic Problems on International Administrative Law:International Rule of Law in Perspective of Globalization and Global Governance
摘要
Abstract
As one way of the adjustment for cross-boundary executive behavior and international govern-ance under global cooperation,international Administrative Law is a new branch of the traditional interna-tional legal system,and its logical starting point and theoretical foundation is global governance.The imple-mentation of global governance and good governance standards requires a series of administrative legal in-struments.Therefore,global governance puts forward the inseparable reference of administrative law,which constitutes a micro foundation of global governance.Most content of global governance can be understood as administrative behavior:formation of rules,executive jurisdiction on interest conflicts,and other types of regulative and executive decisions and administrations.At present,a hierarchical international legal system has been formulated and gradually developed;China should be actively involved in this process.关键词
