基因专利的利益分享机制探析--以人体基因资源为视角
Interest-sharing Mechanism of Gene Patents--from the Perspective of Human Gene Resources
摘要
Abstract
Human gene resources play an important role in biomedicine researches. With the development of biotechnology, the human gene patents have gained great interests. But there are great conflicts in interest sharing. The patentees get great interests from gene patents, while the gene providers are excluded from such interests. In terms of gene interests sharing, we must establish gene providers’ right of prior information and consent, their ownership and their right to use gene resources for free or at a low-cost, on the basis of state authoritative ownership of the gene resources.关键词
