售后赔偿纠纷中的最终报价仲裁研究
Final-offer Arbitration about Post-sale Compensation
摘要
Abstract
Post-sale compensation disputes are increasingly common in commodity consumption .These disputes often cause a lower efficiency and acquire much time and energy .This paper introduces a solution by resorting to final-offer arbitration.The arbitrator determines facts and then selects an offer as the ideal value in its own mind . We discuss three kinds of situations aiming to the ideal value of the arbitrator in which both parties think it should happen .Then we analyze the optimal offer strategies of both parties based on the expected utility maximi-zation principle .The conclusions presented in this paper could provide effective references for the actual arbitra-tion problem .关键词
