摘要
Abstract
The Administrative Coercion Law of the People’s Republic of China,coming into effect on January 1st, 2012,has made an explicit stipulation regarding the standardized administrative compulsory measures that administra-tive law-enforcement officers shall comply strictly with the legal process during carrying out administrative enforcement measures. The paper introduced a case as follows:in a certain administrative penalty case,the law-enforcement of-ficers violated the procedures during executing administrative mandatory detention. The party involved filed the admin-istrative litigation against them,while the court of first instance did not give accession to the appeal. Thus,the party involved have appealed to a higher court,and there is no up-to-date state of the case. The paper expounds the illegal ex-ecution of administrative mandatory measures in this administrative penalty case,and expressed the author’s opinions on the administrative litigation,and thereafter raised suggestions regarding the present administration by law.关键词
