Study on Pre -contract
摘要
Abstract
Pre -contract contract is widely used in the market economy,and the pre -contract is a separate con-tract.Article 2 in Interpretations ofthe Supreme People's Court on Issues Concerning the Application ofLaw for the Trial ofCases Involving Disputes over Sale and Purchase Contracts officially acknowledged the pre -contract for the first time,ant it is of great significance.The subject matter of pre -contract is fairly special compared to the tradi-tional contract,and its founded elements should comply with the requirement of Contract Law.Pre -contracts are different to letters of intention about the founded element and the force of law.There is difference between pre -contract and traditional contract,and it should be noticed.The obligation of violating pre -contract is distinct from traditional contract,and we should not misunderstand that the pre -contract is unfit for compulsory performance.关键词
