Abstract
China and ASEAN located along the Maritime Silk Road enjoy similar stage of economic development. Compared with the ASEAN, this paper finds that national treatments in regional agreements of ASEAN are mostly derived by pre-establishment of negative list to foreign access while China does not. It analyzes the mode of nation-al treatment with negative list adopted currently in free trade zones of Shanghai, Guangdong, Fujian, Tianjin, and then it points out the problems of lengthy list, insufficient transparency and indefinite legal effect of the negative list. Finally, it concludes that in order to help protect our national interest and meet higher standards for develop-ing regional trade and multilateral trading system, it is necessary to improve the national treatment with negative list in free trade zones, thus promoting free trade process along the Maritime Silk Road.关键词
