New Research on the Function of Injunctive Relief on Intellectual Property
摘要
Abstract
Injunctions of intellectual property can be divided into preliminary injunctions and permanent Injunc⁃tions, preliminary injunctions can curb “approaching substantial damage” of intellectual property, permanent in⁃junctions can contribute to reach intellectual property licensing deals, injunctive function of intellectual property protection system is similar as punitive damages. It makes up for the lack of punitive damages responsibility of our intellectual property legal remedies, we should accurately grasp the two Injunctions applicable standards and scope of judicial practice in the field of intellectual property, it not only can compensate for the lack of punitive damages in intellectual property remedies, but also can effectively promote the intellectual property’s licensing deals.关键词
