Abstract
Punitive dam ages are intended to punish the perpetrators sserious w rongfulacts,and preventhim-self/herselforotherssimilartothevictim todecidewhatitsactuallossis,aspunishmentanddeterrencetoperpe-trators and their additionalcom m itm ents com pensation to victim s.Punitive dam ages broke com pensatory dam ages in the form ofequity and realequity tend to pursue.Punitive dam ages lie in the punishm ents thatare carried outto the perpetrators w ith subjective viciousness directly.Punishm entand containm entare the m ain functions ofpuni-tive dam ages.Punitive dam agesare beneficialto the society,itcontributesto the m aintenance ofsocialorderand protecting the security of transactions.关键词
