民事再审检察建议问题研究
Study on Prosecutorial Suggestion about Civil Retrial
摘要
Abstract
Prosecutorial suggestion about civil retrial is a new method of Local prosecutorate directly exercising the right of adjudication su-pervision after the new Civil Suit Law being implemented ,but there are still some questions that are not clear .In order to make the prosecu-torial suggestion play a better role ,its scope of application needs to be expanded to the civil mediation documents against personal interest . The necessary content of prosecutorial suggestion and period of parties applying for prosecution should be clear .More importantly ,the pros-ecutorial suggestion should be endowed with legal effect and the courts need to undertake obligation about reviewing and detailed explaining .关键词
