美国《与台湾关系法》的立法特点与法律实效
The Characteristics and Legal Effects of US’ Taiwan Relations Act
摘要
Abstract
Although Taiwan Relations Act violates the three Joint Communiqué of the United States of A-merica and the People’s Republic of China, and also violates relative international legal principles, it is still a domestic law of US and will be enforced by the government of US. Compared to the Mutual Defense Treaty between the USA and ROC before, this Act makes more concealment on the definition of US-Taiwan Rela-tions, regulates wider scope of US-Taiwan Relations, and grants certain unilateral and practical characters on the sharing mode of the two parts’ rights and obligations. So unlike the framer of this Act had expected, the legal effect of this Act is inherently unstable and doomed to be discounted in performance.关键词
