论《劳动合同法》视角下和谐劳动关系的构建OACHSSCD
On the Construction of Harmonious Labor Relations under the Perspective of"Labor Contract law"
《劳动合同法》开宗明义地提出“构建和谐劳动关系”。自从《劳动合同法》实施以后,我国的书面劳动合同渐趋普及,参加社保的人数明显增长,劳动合同短期化的现象也有所改观,另外劳动者维权意识得到增强,这些给和谐劳动关系的构建带来积极影响。但还存在着集体合同签订率低、劳务派遣制度弊端凸显、工会以及劳动行政部门职能缺失的问题。构建和谐劳动关系还需从以上几方面去努力改革或完善,最终达到构建和谐劳动关系的目标。
