审判公开愿景下审委会审判职能实现的路径选择OACHSSCD
Path choice of realization of judicial committee' s trial function in respect of open trial
审判公开是司法改革中关乎追求审判公正、树立审判权威的重要举措. 审判公开包含审判主体、审判过程、审判结果、裁判理由说明等形式和实质的多重公开. 审判委员会在行使审判权力时也应遵循审判公开这一基本要求,因而对审判委员会制度的改革,应当呼应和吻合审判公开的基本要求,做到审判委员会成员公开、审理案件庭审化,实行回避制度和责任承担制度.
Open trial is an important measure in pursuit of fair judgment and trial authority in the process of judicial reform. Open trial contains multiple openness of form and essence such as the trial subject, the trial process, the trial result, and the reasons for the judges.
