药物临床试验责任保险保障案例的分析

摘要
Abstract
Article of good clinical practice ( GCP ) stipulates that the sponsor shall insure the subject participates in clinical trial and shall compensate the medical charges and economic loss for injury or death as-sociated with trial.It can be proved by 4 clinical trial compensation cases that the actual value of an insurance for medical institute and subject is not significant if the sponsor does not bankrupt.If the sponsor bankrupts or is not at home, the insurance can ensure the compensation from the in-surance company after it pays enough to the subject.Therefore the com-pensation limit of an insurance shall be determined by Tort Law.关键词
