Abstract
The legislation and judicial practice of the enterprise legal person branch in the absence of a legal person in the writ-ten authorization provided by the guarantee of invalid.The identity of a commercial bank is special,and the validity of the branch of the commercial bank shall not be established between the written authorization of the legal person and the causal relationship.In the case that the legislation has not been amended,it should be based on the rule of law,and it is effective to guarantee the effective establishment of the effective elements of the guarantee.关键词
