Substantive Interpretation - An Active and Reasonable Interpretation Method of Criminal Law
摘要
Abstract
The proper interpretation of the law is to interpret the meaning of the rule of law ,its purpose is to correctly understand and apply the law .As a kind of criminal law interpretation method ,substantive interpretation is a kind of method to explain the original intention of the legislation ,and has the legitimacy .Based on the legitimacy of the protection of the legal interests ,substantial explanation not only interpret the text of the provisions of the criminal law ,but also takes the legal spirit behind the provisions as the basis for interpretation so as to determine the reasonable scope of criminal law regulation .Through the research on the concept of substantive interpretation and the necessity of its existence ,we can know that substantive interpretation is a necessary method for the interpretation of criminal law ,and it is a kind of active and reasonable interpretation method of criminal law .关键词
