行政自由裁量权的定位、错位与复位
The Positioning,Mal-positioning and Resetting of Administrative Discretion
摘要
Abstract
Administrative discretion is a unification of the administrative subject combining positive restriction and positive freedom ,under the guidance of the external rule of law and internal ethics spirit for the goal of maximizing the pursuit of the public interest .This positioning will become mal-positioning because of power rent seeking and time-lag of discretionary approaches caused by the limitation of the administrative rationality and information asymmetry between the principal and the agent .A legal basis for the resetting of the discretion is to be provided by strengthening information lite-racy ,clarifying the boundaries of power and compressing rent-seeking space as well as constructing a responsible and effi-cient government .关键词
