A Proposal to Bring Criminal Policy into Criminal Justice System-The Necessity of the Criminal Policy of Ethnic Minorities in the Criminal Law System
摘要
Abstract
The placement of criminal policy in criminal system by Professor Roxin has resolved the con-tradiction between the system of criminal law and criminal dogmatics,as well as the contradictions be-tween social development and legislation lags,which is of great significance to the building of criminal law system in China.Blending ethnic criminal policy in the criminal system,constitutive requirements,illegali-ty and responsibility in the integration of criminal policy and forming rational purpose of crime theory sys-tem,can solve the conflict between individual j ustice and criminal law system stability.Taking into ac-count the criminal law logic system and criminal policy value of dual advantages,the policy would prevent the danger of the rigid criminal law system,and have the advantage of the flexibility of the criminal policy of ethnic groups.关键词
