现代化转型中法治秩序与乡村社会秩序的融合*--基于两起土地纠纷案例的农村社会治理路径探讨
The Integration of Rural Society Regulations and Constitutionality-Discussion on the Approaches of Rural Society Governance Based on Two Land Dispute Cases

Abstract
In the process of urbanization and modernization,rural society of China has been undergoing tremendous change and accompanied with increasing land disputes in rural area,the new risks and uncertainties to rural society as well.Cases analysis shows that rural land dispute solution is more regulated by social regulations of villages,that peasant individual behavior selection depends more on public-recognized order basis and their social integration.“Not to go to the court means winning the litigation”,which reflect the erosion of administrative logics on legal logics,which break the authority,justice and solemnity of the laws in peasants’eyes,currently,the incomplete protection of land asset in formal laws limits the selection of the peasants,which demonstrate that in the process of modernization transition,rural social management can not completely depend on legalized construction.China should set up new order based on laws and realize multiple rural managements by the integration between village regulations and national laws in social context.关键词
