Abstract

Since the pilot projects were launched for collective operating construction land entering the market last year, the effects are remarkable while some outstanding problems still exist. The mechanism of land ownership doesn’t exercise smoothly, the institutional guarantee of collective operating construction land entering the market is absent, and the legal status and rights protection of the main parties is unclear. We put forward recommendations as follows: Enhance the synergies among the reform pilots, and improve the exercise mechanism of collective land ownership based on clearing collective farmers' legal status in the reform pilot of collective assets shares and capabilities; combined with land requisition system reform, extend the market range of collective operating construction land as much as possible through negative list management; straighten out the legal relationship of the main parties, extend appropriately the rights of the collective landowner to recover the collective land use rights, and make detailed provisions of recovery process and compensation.
