摘要

Abstract

Generally, the household name is used in the ifrst housing land registration. However, after the death of the householder, great controversy remains on whether the change of registration should be according to the name or transfer of power. Given this, this paper offers that the theory of family joint property should be introduced into the registration of homestead. Speciifcally, in the ifrst registration, name of householder should be iflled in the holder of the certiifcate column, and at the same time, in the note column, remarking commonly owned by all members of the family, and listing their names. Based on this, after the death of the householder, the right holder can be directly changed into the other family members.
