基于专利视角下的我国LED专利分散产生的影响分析
Research on the Influence of Chinese LED Patent Fragmentation Based on Patent
摘要
Abstract
“Patent fragmentation” means in the specific technology area, the patent concentration degree decreases, patents holders increase, and patent holders enjoy exclusive rights but not rights of using patents. This paper uses PCA to conduct empirical study of LED“patent fragmentation” about its impact on patent license, transfer, the scope of patent rights, abnormal number of invalid patents and the probability of patent infringement. The result shows that the more significant of LED“patent fragmentation”, the more of patents licensing and transferring, the more fees the manufacturer pays. Subsequently the wider of the protection scope of patent rights, the more infringed of common interest, the more difficult about patent commercialization and the more chances of patents infringement. Finally, this paper puts forward some policy suggestion for coping with “patent fragmentation” in LED industry.关键词
